China: Shanghai adopts deferred retirement policy for certain employees Print E-mail
Tthe Shanghai Municipal Labour and Human Resources Bureau has rolled out a new policy under which certain types of employee (mainly professional or technical staff) may defer receiving their pension benefits and continue working for an employer even after reaching the statutory retirement age, provided that the current employer agrees to such arrangement.

Brazil: Spin-offs and the interpretation of the succession of employers doctrine Print E-mail
The Superior Labour Court recently confirmed that the acquirer of a spin-off company will not be jointly liable for company employees towards the vendor, as long as the vendor remains solvent and actively in business at the moment of the transaction. The acquirer will be jointly liable towards the vendor if the spin-off is fraudulent - that is, if the original company does not continue as a genuine business.

Legal implications of a resignation The Labour Court recently considered a case in which several employees resigned without giving proper notice. The court stated that resignation is not invalid if the employee does not give proper notice; it simply creates a breach of contract. The employer can decide whether to accept that breach and waive compliance with the notice period. Alternatively, it can hold the employee to the notice period.
