China: Overtime Work – Mandatory Rules and Internal System Print E-mail
As in other jurisdictions, overtime work in China is subject to legal restrictions on length of overtime hours and leads to overtime compensation. Reportedly, in 2009 more than 60% of the total labour disputes in Beijing, and almost 34% in Shanghai, were related to overtime claims. To avoid disputes and ensure compliance, it is important for enterprises operating in China to structure a compliant internal overtime system.

Belgium: Distinction between blue-collar workers and white-collar employees under debate Print E-mail
In Belgium there is an important distinction between white-collar employees ("bediende" or "employé") and blue-collar workers ("arbeider" or"ouvrier"). A blue-collar worker mainly performs manual work, whereas a white-collar employee is deemed to perform essentially intellectual work.

Belgium: The calculation of the notice period / indemnity in lieu of notice of an employee benefitin Print E-mail
In our newsletters of Belgium at Work - November 2009 and Belgium at Work - January 2010 we informed you that the European Court of Justice rendered a judgment in which was decided that the indemnity in lieu of notice of an employee benefiting from parental leave should be calculated as if the employee had not reduced his working hours, thus on the basis of his full-time salary (case C-116/08, Meerts vs Proost NV).

Belgium: Crisis premium to be paid by the employer in case of dismissal of a blue-collar worker Print E-mail
In Belgium at Work - January 2010 we informed you that blue-collar workers who are dismissed between 1 January 2010 and 30 June 2010 are entitled to the payment of an additional indemnity (the so-called "crisis premium") amounting to 1,666 EUR which in principle is partly born by the employer, in an amount of 555 EUR, and partly by the National Employment Office ("Rijksdienst voor Arbeidsvoorziening" / "Office National de l’Emploi"), in an amount of 1,111 EUR. The amount is not subject to tax withholding and social security contributions. The Belgian government decided to extend this measure until 30 September 2010 whereas a law of 28 April 2010 modified several aspects of the regulation currently in place.
